INDILINGO TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the Indilingo mobile application (the “App”) provided by Indilingo Labs LLP (“Indilingo,” “we,” “us,” or “our”). By downloading, installing, or using the App on your Android device, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Definitions

• App: The Indilingo language-learning application for Android devices.
• Service: The App, any related content, features, and updates we provide.
• User Content: Any text, images, audio, video, translations, or other materials you submit through the Service.

2. Eligibility and Account Registration

1. Age Requirement
   You must be at least 13 years old to use the Service. By using the App, you represent that you meet this age requirement and are legally capable of entering into binding contracts.
2. Account Information
   Certain features may require you to register for an account. When registering, you agree to:
   • Provide accurate, current, and complete information.
   • Maintain and promptly update your registration information to keep it accurate.
   • Maintain the confidentiality of your account credentials.
   • Be fully responsible for all activities that occur under your account.

3. Description of Service

Indilingo is a free-to-use educational App designed to help users learn and practice Indian languages. We may, at our sole discretion and without prior notice:

• Modify, suspend, or discontinue any aspect of the Service, temporarily or permanently.
• Introduce new features or remove existing ones.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights.
• Post or transmit any User Content that is libelous, defamatory, abusive, harassing, hateful, obscene, or otherwise objectionable.
• Infringe the intellectual property or privacy rights of others.
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Interfere with the proper functioning of the Service or impose an unreasonable burden on our infrastructure.
• Use any data-mining, robots, or similar data-gathering tools on or through the Service.

We reserve the right to investigate and take appropriate legal action against anyone who violates these provisions.

5. User Content; License Grant

1. Ownership
   You retain all rights in the User Content you submit to the Service.
2. License to Indilingo
   By submitting User Content, you grant Indilingo a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to:
   • Use, reproduce, adapt, modify, distribute, publicly display, and create derivative works from your User Content.
   • Incorporate your User Content into other works.
3. Warranty
   You represent and warrant that you own or have the necessary rights to grant us this license, and that your User Content does not infringe any third-party rights.

6. Intellectual Property

All intellectual property rights in the Service (including the App’s design, text, graphics, software, and the “Indilingo” name and logo) are owned by Indilingo Labs LLP or its licensors. Unless expressly authorized by us in writing, you may not copy, distribute, modify, create derivative works of, or otherwise exploit any part of the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, available at [privacy policy link], which is incorporated herein by reference. By using the App, you consent to the collection and use of your information as set forth in that policy.

8. Disclaimers; No Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, INDLINGO DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL INDLINGO, ITS AFFILIATES, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Indemnification

You agree to indemnify, defend, and hold harmless Indilingo Labs LLP, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Service.
• Your violation of these Terms.
• Your infringement of any third-party rights.

11. Third-Party Links and Advertisements

The App may contain links to third-party websites, services, or advertisements. We do not endorse and are not responsible for the content, privacy practices, or any other aspect of such third-party offerings. Your use of any linked third-party service is at your own risk and subject to that third party’s terms.

12. Termination

We may suspend or terminate your access to the Service at any time, without notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. Sections 5–11 and 13–16 survive any termination.

13. Governing Law and Dispute Resolution

1. Governing Law
   These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
2. Venue
   Any dispute arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts of Mumbai, India. Alternatively, at our option, disputes may be resolved by binding arbitration in Mumbai under the Arbitration and Conciliation Act, 1996.

14. Copyright Infringement Notices

If you believe any content on the Service infringes your copyright, please send a written notice containing:

1. Your signature (electronic or physical).
2. Identification of the copyrighted work claimed to be infringed.
3. Identification of the infringing material and its location in the App.
4. Your contact information (address, telephone number, email).
5. A statement of good-faith belief that the use is unauthorized.
6. A statement under penalty of perjury that the information is accurate.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Revised” date above. Your continued use of the Service after any changes indicates your acceptance of the new Terms.
